On Oct. 31, 2018, while incarcerated at Florence McClure Women's Correctional Center, client was working in a storage area stocking products on the top shelf. The top shelf held the heaviest items and allegedly collapsed due to bowing caused by over-stocking. The seam of the metal shelf split open and she fell into the opening. She alleges approximately 1500lbs of shelving and stored items fell directly onto her head, neck, and upper body. After a 2 hour delay, she was transported to the emergency department at University Medical Center. CAT scan results showed concerning damage and she was referred to a neurosurgeon. Once transported back to NDOC, she was not seen by a neurosurgeon and her pain became increasingly severe. As a result, she filed a federal complaint seeking monetary, declaratory, and injunctive relief under 28 U.S.C §§ 2201, 2202, and 42 U.S.C. § 1983 because of unsafe work conditions, failure to protect, cruel and unusual punishment, and deliberate indifference to pain and suffering. She is seeking legal representation through the Federal Pro Bono Program.

This is an employment discrimination and retaliation case arising out of pro se Plaintiff’s allegations that his employer - Defendant — violated Title VII of the Civil Rights Act of 1964. Plaintiff sued Defendant for damages, claiming that Defendant discriminated against him, harassed him, and treated him differently because of his race (African American). Plaintiff also claims that, after he reported his complaints to union representatives, Defendant’s management personnel retaliated against him. This action arises from Defendant’s alleged discrimination and retaliation against its employee, Plaintiff. Defendant filed an Answer denying it ever employed Plaintiff. AT&T’s denial is predicated on an assertion by Defendant stating that she conducted an exhaustive search of their employment records and determined there were no records of Plaintiff ever being employed by Defendant from January 2020 onward. Defendant then filed its Motion for Judgment on the Pleadings. Plaintiff first moves to strike Defendant’s reply in support of its motion for judgment on the pleadings, challenging Defendant’s claim that it never employed Plaintiff and that Plaintiff has not sued the correct employer. Plaintiff argues that Defendant is committing fraud and includes a letter from the Equal Employment Opportunity Commission in an effort to show that Defendant’s name and corporate address are correct.
