Client is a Spanish speaking individual who lives in Las Vegas. She and her neighbor, adverse party, share a boundary wall separating their properties. Adverse party had an above-ground pool that he negligently placed within 60 inches of the boundary wall, in violation of Clark County’s building/pool and spa code. In June 2024, the pool lost structural integrity and a deluge of water flooded into client’s backyard, causing a hole in the boundary wall and damage to her backyard. Client has not reported any damage to the inside of her home or any foundation of the home. A lawsuit was filed by client's former pro bono attorney, but the the former attorney is no longer available and needs to withdraw due to personal case load. The parties stipulated to continuing discovery and are open to mediation. The current firm is available to provide a soft handoff of this matter.
