Client is 70 years old and on a fix income. Client previously owned an auto shop prior to retiring and kept his equipment in storage. Client hired adverse party, owner of a body shop, to do a paint job on an old classic truck he owns. Client stated it was a project he has been wanting to do for a long time and was never able to do. Client made a contract with adverse party for $13,400 total. Client gave adverse party a check for $2,500 and equipment from his old shop worth $6,500 in June of 2023. In November 2023 client complained to adverse party since he had not started working on the car and asked for his money and equipment back. Adverse party refused and after a month of dealing with him, client went to the shop to pick up his car and adverse party gave client a check for $2,500. Client tried to cash check and was told check was canceled. Adverse party then moved his shop elsewhere after client found him again this year asking for his money and equipment back. Adverse party stated that he was not going to give him anything. Client stated that when he saw adverse party at shop, he saw his equipment. Client just wants his money and equipment back.
