In Guardianship

The sister of a 12-year-old and a 15-year-old petitioned for an Ex Parte Petition for Emergency Appointment of a Temporary Guardian of them because their mother died. The teenagers currently live with the sister/petitioner. The sister is facing eviction from the home because it is federally subsidized in their deceased mother’s name as head of household and she cannot get it transferred to her without guardianship of the children. The children also still need to be enrolled in school but she reports she cannot do that until she has guardianship. The judge denied the Ex Parte Petition for lack of service and insufficient facts to warrant an emergency. Both of the proposed protected persons’ fathers filed objections to temporary guardianship. At this time, these two proposed protected persons are in need of an attorney to represent their wishes and rights as proposed protected persons. Next Hearing(s): Citation Hearing on 8/16/2022 at 10 am in Department B.
