Will, the plaintiff in a 1983 lawsuit, alleges mistreatment and multiple instances of excessive force used on him by Las Vegas Metropolitan Police Department (LVMPD) Officers as an pretrial detainee and inmate at Clark County Detention Center. In one incident, he claims he sustained serious bruising and swelling to his right arm, wrist, and hand after an officer unnecessarily tightened his cuffs and ran them up and down his arm, then tried to put his cuffed arms through the food slot in his cell. Another officer stopped the officer and medical staff had to perform an x-ray to determine the level of injury. In another incident, he alleges he was racially harassed by the nurse and deprived of his prescribed pain medication, then he was attacked and struck in his injured neck by an officer in his cell after he was put in lock down for the comments he made in response. In another incident, he was taken to the recreation yard during a “cell search shakedown”, and officers handcuffed him, swept his feet out from under him, slammed him backward onto the ground, hog-tied him, and multiple officers stood on his back. They put a taser in his mouth and pulled his boxers down to his knees, then laughed and walked away. One of the sergeants kicked him as he walked away. He reports he passed out because of the lack of oxygen and sustained leg and ankle injuries from the weight of the officers. He further alleges 8th Amendment violations due to a lack of hot water for showers for two months and a lack of heat in his cell from October 15, 2015 – December 15, 2015. They reportedly refused him extra blankets or food and he suffered health and mobility issues due to the cold temperature in his cell. He also alleges 14th Amendment Due Process violations for being kept in a max module in CCDC on multiple occasions, with no commissary or visitation privileges, without a due process hearing. During one period of 60 days in a max module, he reports he lost 70 pounds and experienced severe mental trauma because of lack of food and no access to the commissary.
