In Abuse/Neglect Cases - Children's Attorneys Project

A group of siblings, ages 16, 14, 11, and 3, came into DFS care after reports of physical abuse and neglect akin to torture. The 16-year-old has her own case, therefore this case is for the younger three children. In April 2020, the police responded to a report of a minor tied up in the backyard of the home in 90 degree weather. Based on photos and videos taken by the neighbors and the mother’s own admission, the 11-year-old had been tied up in the backyard for an estimated 2 hours and was only untied because the paternal grandmother came to the home and untied her. She also had bruising on her thigh and wrist that the 11-year-old and the 14-year-old reported was from her parents beating her with a PVC pipe. They explained they were often required to do lunges or kneel in sharp gravel because the mother believes they are stealing food or eating without permission. Further investigation revealed the parents were withholding food from the children. The mother was arrested for felony child abuse and child endangerment and the father refused to return to the family home and cooperate at the time. These three children are in need of an attorney to represent their wishes and legal rights as to permanency, placement, visitation and to ensure appropriate services, including educational services, are in place. Next Hearing(s): Evidentiary Hearing for Mother on 6/2/2022 at 1:30 pm; Permanency Planning Hearing on 10/11/2022 at 2:15 pm in Courtroom 11.
