In Abuse/Neglect Cases - Children's Attorneys Project

A 13-year-old girl came into DFS care on March 3, 2020 with another child. She was living with her legal guardians because her father was found to be responsible for environmental neglect, medical neglect, and educational neglect in addition to lacking resources. He is currently unable to provide care for her due to physical or mental incapacity that requires him to live in a skilled nursing facility. The 13-year-old was then removed from the home after they reported physical and emotional abuse by the adults, including excessive punishment and physical abuse. The adults forced her and the 9-year-old to stand in a corner for between 1 day and 2 weeks, struck them on the head, pulled their hair, and choked them. There were also two foster children in the home (referred to as “the fosters”) who she stated had different rules to follow in the home. She fears the adults and is afraid of returning to their care. She was represented but the attorney is no longer available to assist. In addition, the 13-year-old has another DFS case pending with the 9-year-old against the guardians.
