Two year old child is in protective custody over concerns regarding her mother’s lack of stability. There are questions as to whether mother is using illegal substances, managing her mental health, and has resources for her daughter. The mother previously provided her mother, this child’s grandmother, had a temporary guardianship over the child, but the grandmother reports that mother frequently threatens to take away the child. The father was recently released from prison, and wants to be in her life. He also opposes giving legal guardianship to the maternal grandmother. DFS did not want to keep the child with her grandmother when they became involved – grandmother has a prior court substantiation for child abuse/neglect. The court has ordered the child remain there, with paternal grandparents supervising visits between the child and her father. Placement will likely be at issue going forward. This child is in need of an attorney to represent her legal rights and wishes as to placement, permanency, visitations and to ensure appropriate services are in place. There is a Disposition Hearing set for January 30, 2018 at 11:00 a.m. in Courtroom 22.
