A 2 year old boy came into DFS custody in 2015 due to neglect and his natural mother and father’s parental rights were terminated in March, 2017. Client has been living with foster parents since January, 2017 and they are an adoptive resource. There is a maternal aunt who adopted two of this client’s half siblings and she would like to adopt this child. She previously had placement of this child from October, 2015 to January, 2017 along with the two siblings she adopted, however, DFS removed all of the children from her care in January, 2017 stating she was unable to meet the children’s medical, therapy and medication management needs. Eventually two siblings were returned to her care and their adoption was finalized. She states she has a better job and a new place to live and is now able to care for all of the children. The client’s current DFS permanency plan is adoption with the foster parents. The foster parents have retained counsel. A staff CAP attorney previously represented the client’s siblings and is not able to represent this client due to potential conflict. This client needs an attorney to represent his legal interests regarding permanency and sibling visitation.
