A 1 month old baby girl came into DFS care in July, 2017 when she was born exposed to drugs. Mom and child tested positive for amphetamines. Child was treated for withdrawal. Mom is an addict and bipolar. She lost legal rights to children in the past. Paternity may need to be established because there is no dad on the birth certificate. Dad’s identity is known; his location is not. Both parents are homeless and neither appeared in court. Despite this, mom expressed a desire to participate in a case plan. The parents may have supervised visitation if they make contact. The permanency plan is reunification. The Indian Child Welfare Act may apply. Presumed dad may be Cherokee. Client needs an attorney to represent her legal interests regarding permanency, placement, and visitation and to ensure the proper services are in place.
