Three siblings, ages 4 to 1, came into DFS care due to abuse and/or neglect in addition to dad’s alleged sexual abuse. Mom is avoiding contact with the Department and dad is under investigation. Both parents have a drug history. Mom blames her recent drug use on the children. Mom is member of a Native American tribe and the children are protected under the tribe’s rights so the Indian Child Welfare Act applies to this case. The tribe was involved in her 7 previous CPS investigations and they are not interested in taking jurisdiction over the children. They filed a motion to monitor the case. Clients need an attorney to represent their legal interests regarding permanency, placement, and visitation and to ensure the proper services are in place.
