A 9 month old baby girl came into DFS custody in October, 2016 due to her mothers’ drug use. Mother has history with DFS and her parental rights to another child were terminated. Client is currently placed with foster parents, who adopted her half-sibling. She is reportedly doing well in this placement and has been with them since October, 2016. They are an adoptive resource for this client. In March, 2017, after other potential fathers were ruled out, client’s natural father was identified. Dad is incarcerated with an expected release date in October, 2017. He requested that child be placed with his mother and sister, however when DFS conducted the background check, they found a DV charge from 2010 that was not disclosed. Family members provided an explanation of DV incident but DFS will need to get management approval in order to place child with Dad’s family. Client needs an attorney to represent her legal interests regarding permanency, placement, and visitation and to ensure the proper services are in place.
